here is the scenario:

person A is hurt in an accident and has $20,000 in hospital bills which their insurance pays for. 6 yrs later person B responsible for the accident (who is being sued) settles. can the insurance company now sue for/claim their money back from person A, or, because they settled and the amount is not on public record, do they not have a legal right to?

umm well first i can't give legal advice at all and this is not an area i have any experience in but i can make some guesses. what state is this in?

my guess is this:
whether the money comes from settlement or judgment is not relevant

might be able to keep it to the extent the money paid by B is to cover damage A suffered that was not covered by insurance. so you would have to look into whose claims have priority if the money paid doesn't cover all of the damages. this is all a guess though!

eight months pass...

so harbl:

if a personal injury suit has reached the settlement stage, and then the insurance company of the defendant decides to not sign the release, then they agree to but they write out the check 'incorrectly', and now the judge has told them they will have to pay $1000 per day they are late writing out a check that can actually be cleared.... well, what do you think this means? they can't pay? they're going bankrupt and are stalling for time so they don't have to fork out any money? once a settlement has been reached and they have signed a release, is there anyway they can get out of paying it?

ummmmm this is not really a lawyerly question. i don't know about insurance companies or any type of business. i do know you can get out of paying by being "insolvent," i.e., bankrupt. could be what's happening, or they're just jerks.
